Birth injury results in $55 million settlement

When expectant parents rush to the hospital for the birth of the child they have been eagerly anticipating, a birth injury can be devastating. When a mother puts her own well being and that of her child's into the hands of a medical provider it's expected that proper procedure will result in a successful delivery. Unfortunately, this is not always the case.

Although the incident did not take place in West Virginia, readers may be interested to learn about a medical malpractice lawsuit that was settled recently resulting in a $55 million verdict. The birth began as expected, with the couple at home with a midwife. Except when the woman was ready to give birth, the baby became stuck. The woman was rushed to the hospital by ambulance.

At the hospital, doctors ordered an emergency C-section. The key word is emergency, which would indicate that the procedure was necessary immediately. Instead, medical providers waited a full two hours to perform the necessary C-section. The child is now suffering from severe developmental disorders.

The couple sued the hospital saying that doctors waited too long to perform the emergency C-section. A jury recently awarded the family $55 million. The hospital denies the allegations. A spokesperson said that they believe the medical care provided was appropriate given the circumstances. The hospital plans to appeal the decision.
