Woman charged in fatal motorcycle accident

Motorcycle accidents can have permanent consequences and cause serious injuries for victims. Fortunately, victims may seek help through the legal system.

Charges were recently filed in nearby North Carolina against a woman police say caused a fatal motorcycle crash. The motorcycle accident occurred when the woman, in a passenger car, pulled out in front of the motorcycle, causing the motorcycle to slam into the car. The driver of the motorcycle succumbed to his injuries at a local hospital. Police say that the woman turned left into the path of the oncoming motorcycle; she has been charged with misdemeanor death by motor vehicle.

Viriginia motorists can have difficulty seeing motorcycles on the road, which can lead to motorcycle collisions and catastrophic injuries. This is because motorcycles are smaller visual targets and can easily be hidden by other vehicles, driving or weather conditions. This can be especially true at intersections where 70 percent of vehicle-motorcycle collisions occur. Drivers may be responsible for failure to yield when the oncoming traffic is a motorcycle even if the driver had difficulty seeing the motorcycle.

In cases when a negligent driver is cited or charged by police, Virginia motorcycle accident victims may be able to more easily pursue the negligent party's liability for the injuries suffered. Because motorcycles accidents can result in catastrophic injuries, permanent disability or even death, damages may be available to motorcycle accident victims or their families. Traffic law violations can be considered "negligence per se." According to this legal theory, a motorcycle accident victim injured by a negligent driver that was in violation of traffic laws at the time of the motorcycle accident may be able to claim that the driver's failure to abide by traffic laws is evidence that the driver was negligent.

Because of the catastrophic nature of many motorcycle collisions, the legal system is available to help motorcycle accident victims recover damages for their injuries. This can provide peace of mind following a motorcycle crash.
