West Virginia truck accident results in injury, criminal charges

Truck crashes in West Virginia can result in serious injuries that can sometimes be both physical and emotional. A recent semi-truck accident sent one woman to the hospital and has the left the truck driver facing criminal charges.

Following the truck accident, police said that prosecutors will charge the truck driver. Authorities reported that the tractor trailer was traveling along the roadway when the truck driver made a left turn and struck a car already in the roadway that the truck was entering. Although the injuries were said to be non-life threatening, officials transported the woman in the car to the hospital with a possible fracture to her ankle. Authorities said that weather was likely a factor and urged drivers traveling in it to slow down.

To successfully pursue compensation from a truck driver or trucking company, it will be necessary for the victim to prove fault on the part of one or both parties. While establishing a truck driver's negligence, for example, courts have analyzed the way truck drivers take left-hand turns in certain cases and determined that the maneuver demonstrated a lack of caution. In other situations, if a driver has been cited or criminally charged, the legal principle of "negligence per se" indicates fault on the part of the driver.

In any case, the victim will have to show that the truck driver or company failed to meet the duty of reasonable caution and care and harm resulted.
