West Virginia bridge pile up results in injuries

The future may seem uncertain to car accident victims, however, the legal process seeks to ensure peace of mind and offer help to injured victims.

A nearby West Virginia bridge was recently the site of car accident involving more than three dozen cars and multiple injuries. Nine people were transported to the hospital with injuries and some had to be cut from their cars. Some people were trapped for hours in their vehicles. It was indicated that weather and roadway conditions may have been factors in the multi-car accident.

Proving liability in a car accident is not always automatic but may be made somewhat easier in some circumstances if the negligent driver from whom compensation is sought engaged in certain activities in causing the accident. Common factors that are used to determine if a driver was negligent include if a driver disobeyed posted traffic lights or signs, failed to signal an intention to turn while driving, drove above or below the posted speed limit, drove under the influence of alcohol or drugs or disregarded weather or other traffic conditions.

Sometimes, weather conditions will dictate that a careful driver will need to reduce the speed of the car. If the conditions call for it, and the driver fails to respond and causes an accident that results in injury, the driver may be liable for negligence. To recover compensation, the injured victim will need to establish the liability of the negligent driver for the accident. Once that has been established, damages for injuries may be available to the victim. The process commonly involves insurance companies and may also involve the courts or never reach the court if a settlement is arrived at.
