One teen killed and other teens injured in tragic W. VA. accident


Victims, and families of victims, have recourse through the legal system when serious injury or a loved one's death occurs in a car accident.

A recent West Virginia crash in a nearby community, involving many teenagers, resulted in tragedy. One of the teens was killed in the car accident and ten others were injured. The ages of those injured ranged from 14 to 20 and all are being treated for injuries ranging from minor to severe. The driver lost control of the vehicle, traveling over a creek and crashing into a tree. The five people in the back of the truck were ejected and six others were in the cab of the vehicle. The accident investigation has not yet resulted in any charges but state police commented that charges may be forthcoming based on the outcome of the investigation and tests. Police reported that marijuana was found in the vehicle.

Personal injury and wrongful death lawsuits may be brought just as any other personal injury lawsuit in circumstances when those injured and killed are passengers in the vehicle of a negligent driver. This can be the case when the driver was a drunk driver or in some other way impaired when the driver caused the accident.

It is important to remember that insurance companies are usually involved in personal injury and wrongful death claims. Often, insurance companies provide compensation to the victims for damages. Damages in either a personal injury lawsuit or wrongful death lawsuit can include medical expenses or if the situation warrants, funeral expenses. Pain and suffering damages may also be available to victims and the families of victims in either case.

Though it is not possible to quantify the losses a Virginia victim and their loved ones suffer when involved in a car accident, a civil suit is one way to hold the negligent party accountable for their actions and ease financial responsibilities at the same time.
