Motorcycle accident claims life of motorcyclist

Motorcycle accident victims in West Virginia should understand that in circumstances when a driver negligently injures a rider, that driver may face liability to the rider for damages.

A motorcycle accident in a neighboring state recently resulted in the death of a motorcyclist. The motorcycle was involved in a crash with a pickup truck. The motorcycle accident claimed the life of a 39-year old motorcycle rider. The pickup truck, driven by a 31-year old man, was towing a small trailer. The motorcycle rider died as a result of injuries suffered in the accident. The police are investigating the accident and a reconstruction team is assisting with the investigation.

Motorcycle accidents can result in devastating injuries, including head, brain, neck and spinal cord injuries and even death. This is due to the vulnerability motorcycles face on the road and the increased likelihood that a negligent driver, such as a distracted driver, will not observe the motorcycle and will cause an accident. In two-thirds of motorcycle accidents with a passenger vehicle, the passenger vehicle violated the motorcycle's right of way and caused the accident.

Because motorcycle accidents can result in catastrophic injuries and sometimes permanent disability or death, motorcycle accidents victims have legal options to aid with damages that are suffered as a result. The rights of motorcycle accident victims are protected so that victims can recover medical expenses, future medical costs and care, lost wages, lost-earning capacity and pain and suffering damages. When the motorcycle accident victim has died as a result of a fatal motorcycle crash, family members of victims may be able to recover damages as well for medical and funeral expenses and pain and suffering.

The nature and amount of compensation an injured victim, or victim's family, can recover depends on the circumstances of the accident. A trained personal injury attorney can help an injured motorcycle accident victim, or family members of a lost loved one, evaluate damages and pursue a claim against the negligent party.
