Cabell man faces personal injury lawsuit following car accident

A couple from out-of-state is suing a Cabell man following a car collision. The couple alleges that the man was driving carelessly and recklessly which caused him to lose control of his vehicle, cross over the center line, causing the accident, and strike the couple in their vehicle. The couple alleges that the man was negligent and asserts that they have suffered a loss of companionship as a result of the car accident and are seeking a variety of damages.

Car accidents can be caused by a variety of different types of negligent behavior. Drivers can behave carelessly, or negligently, by driving as a distracted driver or texting and driving, as well as in other ways. A negligent driver may be liable to injured victims for damages for the serious injuries that can result in a car collision.

A negligent driver may face liability for compensation of damages including medical expenses, on-going medical care, lost wages, lost-earning capacity and pain and suffering damages when appropriate. Typically, an injured victim will bring a claim for damages against the negligent party. Once the claim process has begun, insurance companies are often involved in compensating the victim. Recovery of compensation can typically either be through the settlement process or a trial.

Because there are many important considerations when a victim has been injured in a car accident, it is important to understand damages and the process of bringing a claim for damages. A trained personal injury attorney can better explain this process to injured victims and help victims determine the next step.
