West Virginia man files lawsuit for injuries from car accident

Car accident victims may face many losses and challenges following a car collision, which is why the legal system is available to protect victims of car accidents.

A West Virginia man has brought a personal injury claim against a driver and the company that employed the driver for serious injuries sustained in a car accident. The victim alleges in his lawsuit that at the time of the accident, he was yielding to traffic and preparing to turn left when the other driver collided with him. The victim alleges that the driver who crashed into him was negligent in doing so and was not paying attention to the traffic around him. The victim is seeking damages for his injuries.

Whenever a driver behaves in a negligent manner, such as a distracted driver, the negligent driver may be liable to the injured victim for damages. In addition, depending on the relationship between an employee driver and an employer, the employer also may be liable to the injured victim for damages. The liability of the employer also may depend on the nature of the activity the employee was engaged in at the time the negligence occurred.

When injured by the negligence of another, an injury victim may be able to recover a variety of damages for serious injuries suffered. A car collision can result in a variety of injuries and victims may be able to recover compensation for medical expenses, lost earnings, loss of future earning capacity and damages for pain and suffering. When a party has failed to exercise due care for the safety of others, the party may be liable for negligence and responsible to the victim for damages.

Car accident victims may find the need to seek compensation for injuries suffered in a car collision. A trained personal injury attorney can help an injury victim better understand the damages suffered and the process of bringing a claim for the same.
