Couples sues truck driver and trucking companies in West Virginia

It is not uncommon to see large trucks traveling at all hours on the roadways in West Virginia. Whether it is to make a large shipment or delivery, society relies on semi-trucks and tractor-trailers to ship goods to various destinations. Although these massive trucks are beneficial, they could also create dangers on the roadway. If a truck driver fails to check their blind spots or is fatigued, they could cause a serious accident.

Suffering injuries from a trucking accident may not be the end of the story as various damages can begin to pile up soon after. A couple recently brought a claim against a truck driver and the companies the truck driver works for following a truck accident in West Virginia that injured the couple.

The husband and wife brought a lawsuit against the truck driver and truck companies alleging that the truck driver was negligent, causing the truck accident and injuries. The couple asserts that they received injuries when the truck driver collided with them in the tractor-trailer he was driving. A trucking company owns the truck trailer, while another company owns the flatbed.

The couple asserts that the husband received injuries in the trucking accident that resulted in medical expenses amounting to $6,007. According to the couple, he will require further medical care and the wife suffered the loss of services and the society of her husband because of the accident. Damages from truck accidents can include physical and medical damages, as well as emotional damages. Unfortunately, due to the significant size disparity between trucks and other passenger vehicles, truck accidents can inflict massive harm on truck accident victims.

When a truck accident victim has been injured, the victim may have the option to pursue a claim against a negligent truck driver, a trucking company or both. The ability of victims to seek compensation for damages from a trucking company depends on the relationship between the negligent truck driver and the trucking company and the nature of the truck driver's activities at the time of the accident. Even an inattentive truck driver or a truck driver who is speeding may be liable for negligence.

Victims may not have to suffer the weighty toll of physical, financial and emotional damages without assistance. The legal system recognizes the significant impact a truck accident can have on victims and seeks to protect them accordingly.
