Passenger on motorcycle injured in rural accident with SUV


As any West Virginian who has ridden on a motorcycle knows, the thrill of the open road is often tempered by the knowledge that an accident with another motor vehicle may be just around the next corner. For a motorcyclist, this is generally a losing proposition. For this reason, motorcyclists should always observe speed limits and pay close attention to other vehicles and weather and road conditions. In addition, everyone on a motorcycle should wear a helmet that meets federal standards and clothing that offers some protection in the event of a motorcycle accident.

The passenger on one motorcycle traveling on a stretch of U.S. Route 50 near Grafton, 25 miles southwest of Morgantown, may be glad her injuries were not more serious following an accident with a sport utility vehicle shortly before noon on a recent Monday. According to the West Virginia State Police, the 11:45 a.m. accident near Meadload Road occurred when the motorcycle driver hit the side of the SUV.

The passenger, a 44-year-old woman, was transported to a nearby hospital for treatment of a possible broken ankle and road rash. Neither the SUV driver nor the motorcycle operator were injured. The State Police are investigating the incident. Whether criminal charges will be filed as a result of the accident is not yet known.

Which party was most at fault -- the motorcyclist or the SUV driver -- may well determine who must compensate the motorcycle passenger for treatment of her injuries.

In cases like this one if a failure to yield was the cause, then it may be that other driver is at fault. If so, the person may be issued a criminal citation. Even if a citation is not issued, motorcyclists may be able to file a personal injury suit to recover the costs of medical treatment and rehabilitation following a motorcycle accident caused by the negligence of another.
