West Virginia ATV accident leads to serious injuries

Two people were sent to the hospital in West Virginia on Christmas following a collision between an ATV and a pickup truck. The automobile accident occurred when the pickup truck hit an ATV in front of a local elementary school. The driver of the ATV was ejected while the truck driver had to crawl out of the pickup after it rolled and caused other damage. The driver of the truck was airlifted to a hospital and the driver of the ATV was taken to the hospital by ambulance. The auto accident is currently being investigated.

ATVs are used for recreational and practical purposes throughout the country. In 2005 and 2006, there have been approximately 800 reported ATV deaths in each year. However, there are ways to stay safe on an ATV. A few of these include observing safety precautions such as using helmets, prohibiting children from using ATVs and obtaining an understanding of the unique characteristics of an all-terrain vehicle as well as its limitations. Drivers should also carry a communication device on the vehicle at all times.

For those injured in an auto accident, they may want to seek compensation for their damages from the negligent party. Negligence occurs when a party fails to exercise ordinary care under the circumstances, causing injury to another party. Physical and emotional damages following an auto accident can be serious. The types of damages that may be available to victims following any vehicle accident include compensation for medical expenses, lost wages and pain and suffering.

While automotive accidents can result in serious injury and emotional trauma, resources and legal options are available for the victims. Understanding them can sometimes seem complex but can be beneficial.
