West Virginia ATV versus SUV accident causes injuries

In the event an ATV rider suffers injury as a result of another's negligence, legal options may be available to offer help.

An ATV versus SUV accident recently sent a man to the hospital. Authorities in a neighboring community were called to the scene of the ATV accident. One man had to be flown to the hospital. County, fire, sheriff and state police authorities all responded to the scene of the crash.

ATVs have increased in popularity and as a result, ATV accidents are also more common. While fatal injuries can sometimes result, some of the most serious types of non-fatal injuries that can occur as a result of an ATV accident are traumatic brain injuries, spinal cord injuries, neck injuries, head injuries (such as concussions) and abdominal injuries, as well as fractures. All of these injuries can be serious and recovery can be costly and difficult. These injuries can occur in an ATV rollover, crash or accident.

Because of this, if a negligent party causes a recreational vehicle accident, the injured victim may be able to bring a personal injury lawsuit to recover damages, including medical expenses and continuing medical care. To prove negligence, the victim must demonstrate that the negligent party owed a duty of care to the victim and that the negligent party failed to observe that duty. The victim must also show that the negligent party's actions caused the harm suffered. Once this has been established, the victim may be able to recover damages to help with the harm suffered.

ATVs are very popular amongst many people today. Because of this, it is important riders understand the legal options available to them when they are injured.
