ATV injury claims similar to other personal injury claims

ATV accident victims may experience the same costs and frustrations as other types of accident victims, although the West Virginia legal system can help with both.

An ATV accident left an ATV rider injured in a West Virginia community recently. The ATV and another vehicle collided, and the ATV rider had to be taken to a hospital for treatment and care. The ATV was traveling east on a local roadway at the time of the crash. According to local news reports, citations in the accident are pending.

ATV accident liability is similar to other types of vehicle accidents which result in a personal injury lawsuit. This is especially true when another vehicle is involved. As is true of other types of personal injury claims, such as those for a car, motorcycle or truck accident, a negligent driver may be required to pay compensation for damages from an ATV accident. A distracted driver or drunk driver who strikes an ATV can be liable for medical expenses in the form of damages to the injured ATV rider.

Other types of damages may be available to an injured ATV rider as well. Lost wages and pain and suffering damages may be appropriate based on the circumstances of the case. Additionally, because serious injury can result from an ATV accident, future medical expenses may be required if ongoing medical care is needed as part of the ATV rider's recovery. Physical, mental and emotional damages can all result from a brain injury or other type of head injury, which are common in recreational vehicle accidents.
