ATV accident injures woman; driver may have been drunk

ATV accidents can result in serious, and costly, injuries and significant damages to victims.

A man in a community just a few hours from Cabell County was recently arrested on charges related to an ATV accident. Police responded to a report of an ATV crash and found a woman in an embankment with serious injuries. No ATV, however, was present. Leaving the accident scene, police found a man who was apparently intoxicated and who claimed not to know anything about an accident. The woman had to be transported by helicopter to the hospital. The man has been charged with public intoxication, leaving the scene of an accident involving serious injuries and failure to render aid. Police believe the ATV was removed before they arrived but are still searching for it.

ATV accidents can result in serious injuries. With the increase in the common use of ATVs have come ATV accidents. When someone has negligently caused an ATV accident, that person may be liable to the victim for injuries. This can include if the victim was a passenger injured by the driver's negligence. Oftentimes, criminal charges, or citations related to the accident, will serve as evidence of negligence.

ATV accidents often result in head, brain, spinal cord and back injuries. One of the most serious non-fatal injuries that can result from an ATV accident is a traumatic brain injury. Traumatic brain injuries can require costly care and rehabilitation. In addition to medical expenses and the cost of on-going medical care, the victim may also suffer lost wages and lost earning capacity. All of these types of damages may be recoverable by a victim of an ATV accident.

A skilled personal injury attorney can help advise injured victims of their rights and the potential responsibility of a party that is liable for the accident. Circumstances of accidents can vary so it is best to consult with an attorney to help ensure a complete economic as well as physical recovery.
