Child killed and others injured in nearby head-on car accident

Legal resources are available to protect victims of car accidents and family members of car accident victims.

In a community only a couple hours south of Cabell, a car collision recently injured two people and claimed the life of a child. According to the accident investigation, a driver in the westbound lane came upon a stopped vehicle and in an attempt to avoid that vehicle, crossed into the eastbound lane hitting another car head-on. Both the driver of the vehicle that was struck and a passenger were injured and a child who was also a passenger in the car was killed. The child was taken by helicopter to the hospital where she died.

According to police, the accident investigation into the head-on collision is ongoing and police did not state whether or not the driver that crossed the center line, who was taken to the hospital for treatment of injuries, will face charges associated with the accident. When a victim is injured in a car accident, both emotional and financial challenges may present themselves. This may also be true when a loved one or family members is killed in a car collision. When the harm results from the negligence, of carelessness, of a negligent driver, victims may be able to recover compensation for the harm.

Victims, or families of victims, can bring a claim for damages based on the liability of the negligent driver. In personal injury cases, victims may be able to recover medical expenses, lost wages and pain and suffering damages based on the harm suffered as a result of the car accident. Likewise, family members of victims may be able to recover medical and funeral expenses, and pain and suffering damages, through a wrongful death claim based on the liability of the negligent driver.

Victims of car accidents, and families of victims, have legal options available to compensate for harm suffered. A claim for damages will vary with the unique circumstances of each case so it is best to thoroughly understand how damages are evaluated when considering a claim for compensation of damages for harm.
