Wayne County four-car accident prompts lawsuit

Following a serious car accident, the most important thing is to make sure the victim is restored to health. Depending on the severity of the injuries, the healing process can take quite some time. This can mean extensive medical or hospital bills and missed time from work. With the large number of hospital bills following an accident, most people begin to wonder how they will ever get paid.

One woman in Wayne County, West Virginia, is seeking help to pay for damages after she was involved in a car accident in April, 2012. The woman recently filed a lawsuit against both the driver of the other vehicle, as well as the office supply store that owned the vehicle.

The complaint filed in Wayne Circuit Court alleges that the woman was driving along W.Va. 152 when the other driver struck the back of her car. The initial impact led to a four-car collision. The complaint accuses the other driver of failing to maintain control of his car, as well as failing to keep a proper lookout and failing to follow her car at a safe distance.

According to the victim, the driver's actions are indicative of careless and reckless driving, along with negligent driving. She claims that the driver's behavior caused the accident, and therefore, led to her injuries. The victim is asking the negligent driver and the owner of the vehicle to pay court costs and compensatory damages.

Victims of an auto accident can often file lawsuits against the negligent party and may even be able to include the negligent party's employer. A claim of respondeat superior is successful if it can be shown that the negligent behavior or accident occurred during the driver's scope of employment.
