West Virginia man pursues wrongful death lawsuit

General Motors has been under fire recently for a number of recall and safety issues, some of which have led to accident fatalities and injuries. The tragic stories detail just how car accidents are not always the result of a distracted driver or negligent driver; sometimes, manufacturers of the car itself may be responsible.

A West Virginia man lost his wife and unborn child in 2006 after a car crash in Mount Airy, NC. The husband and father is now suing GM. His complaint alleges that a faulty ignition switch in the GM Chevrolet Cobalt caused the fatal accident.

The 26-year-old MRI technician was driving to work on that fateful morning. She was pregnant with the couple's second child at the time. It is argued that her brakes failed at an exit ramp, causing her to lose control of the car and landing her in the path of an oncoming truck. The airbags in her car also failed to deploy.

According to the husband's wrongful death lawsuit, GM applied cost-saving techniques that overruled safety standards and resulted in defective vehicle parts. The complaint also states that GM had knowledge about the defective ignition parts starting in 2001. The switches, part of a large-scale recall this year, had a tendency to slip into different positions while the cars were running, which impacted everything from brakes to steering to airbags.

Unfortunately the recall was too late for many, including this man's wife and unborn child. In wrongful death situations, although the pain may feel like too much to bear, it may be necessary to pursue legal action to ensure that the negligent parties are held responsible for their behavior and that the grieving family members are financially compensated for their significant loss of a loved one.
