Man files claim seeking compensation against tow truck driver

West Virginia is like most states in that car accidents occur on a daily basis. There are many reasons why these accidents occur, but one of the biggest reasons is driver negligence. Although the law requires all drivers to exercise due caution whenever they operate their vehicles, not all drivers are responsible. Unfortunately, when they disregard the safety of other people, the results are often catastrophic. Car accidents can cause serious injuries as well as kill people.

In Beckley recently, a man filed a claim for injuries he allegedly sustained in a car accident in 2012 in Shady Spring, some 50 miles southeast of Charleston. According to the legal complaint, the plaintiff was heading north on Ritter Drive on Oct. 10 when the driver of a tow truck following behind him attempted to pass his car using the southbound lane. When a southbound vehicle appeared, the truck driver swerved back into the northbound lane and struck the plaintiff's vehicle. The driver of a third vehicle veered off the road to avoid colliding with the plaintiff's vehicle. The plaintiff accused the tow truck driver of negligence and is now suing for medical expenses.

Personal injury claims can follow in the wake of a car accident if negligence was determined to be a contributing factor. Following most accidents, authorities assess the contribution of every party involved in a mishap. If the accident was caused primarily by one party, then any other party who sustained injuries can sue for compensation.

With the right help, anyone who has been injured in a car crash and now faces substantial medical bills and lost income because of time off from work can hold negligent parties responsible.
