Motorcyclist dies when driver pulls out of driveway and onto road

Although riding a motorcycle on an open road has its charms for many riders, this has to be tempered by the knowledge that a slow-moving truck, school bus, tractor or car may be just around the next curve in the road. For this reason, motorcyclists should be extra cautious when traveling at higher speeds, especially at night. No rider knows for sure if another driver will see a bike in time to avoid hitting it.

This may be what happened recently just east of Huntington when a Cabell County driver pulled onto West Virginia Route 2 and into the path of a motorcycle. The resulting motorcycle accident left one unidentified person dead.

According to Cabell County Sheriff's Deputies, a 46-year-old Lesage man was pulling out of his driveway in the 6000 block of Route 2 around 9:30 p.m. when the accident happened. The road was closed for an undisclosed amount of time as crews cleaned up the fatal motorcycle accident scene.

Deputies say the man admitted having taken Xanax, a prescription drug, before driving. He faces felony charges of driving under the influence-death. He is currently being detained in Barboursville at the Western Regional Jail.

In this case, surviving family members of the person who died will probably follow closely to see what charges are filed against the car driver. Whether or not prosecutors offer a plea deal or pursue felony charges against the man, the motorcyclist's relatives may have the option of taking civil action themselves.

If the man goes to trial and evidence is introduced to show he was under the influence of the drug he allegedly admitted taking, then family members could use that fact in a wrongful death suit. If successful, they could be awarded compensation for the loss of their loved one.
