Hit by an uninsured driver in West Virginia?

Approximately one out of every 10 drivers on West Virginia roads is uninsured. If you are injured in an accident caused by an uninsured driver, you will have to look somewhere else for money to pay your medical bills, lost wages and other damages.

One source of compensation is your own coverage for uninsured and underinsured motorists. All drivers in West Virginia are required to carry at least $20,000 in UM/UIM coverage. You have the option of buying more, and doing just that is one of the best things you can do to protect your family.

UM/UIM coverage protects you not just from uninsured drivers but underinsured drivers. Many drivers in West Virginia carry the minimum required liability insurance, which is $20,000 for one person and $40,000 for all persons injured in an accident. If you suffer a serious injury, $20,000 will not go far in paying your bills.

While UM/UIM coverage is from your insurance company, it still pays to have a lawyer handle your claim. Your insurance company is an adversarial party when you file a UM/UIM claim, and may offer you less that you deserve. If you make a mistake (such as settle a claim without contacting your insurance company), it may deny payment.

An attorney may also find other liable parties, such as:

  • The auto manufacturer, if a car defect caused your injury
  • The local government, if defective road conditions caused the accident
  • A bar that over served alcohol to the other driver
