Pedestrian dies after being struck by vehicle in crosswalk

West Virginia residents are always cautioned to cross streets in crosswalks and where crossing signals are available. This is because the signage provides pedestrians and drivers with information regarding the presence of each other on the roads. However, a pedestrian who was apparently following these rules still suffered fatal injuries when a negligent driver struck her while she was crossing the road.

The accident happened in Morgantown and resulted in the death of a 21-year-old woman. The victim was crossing Patterson Drive in the town when a sport utility vehicle ran into her. The wreck is under investigation by local authorities and at this time no charges have been filed against the driver of the involved vehicle.

Pedestrian accidents are true tragedies that generally can be avoided. In this case, the victim was apparently where she was supposed to be when a driver failed to yield to her presence in a designated pedestrian crossing path. Even if the driver in this case is criminally charged with the victim's death the family members of the victim may still pursue their losses from that driver in civil court.

Civil claims based on personal injuries and wrongful deaths can result in awards of damages to the victims of those incidents. In this case, the family members of the deceased victim may be able to pursue damages for the financial and emotional hardships they have been forced to endure due to her death. Compensation for funeral expenses, accident-related medical care, pain and suffering, loss of companionship and other damages can be awarded when personal injury and wrongful death claims are properly pleaded.
